Terms of Service — Learning Time

Availability: Learning Time is offered in Hong Kong, Indonesia, and select Southeast Asian markets (Singapore, Malaysia, Thailand, Philippines, Vietnam). It is not currently available in the European Economic Area, United Kingdom, or United States.
These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Learning Time Digital Limited, a Hong Kong body corporate (Business Registration No. 79301879-000-12-25-4) with its registered office at 5/F, 88 Lockhart Road, Wan Chai, Hong Kong ("Learning Time", "we", "our", "us"). They govern your download, installation, and use of the Learning Time mobile application and any related services (together, the "Service").
Please read these Terms carefully. By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
TL;DR — the key points
- Learning Time is a tool for parents and adult guardians to track a child's early development. It is not a medical device or diagnostic tool, and nothing it shows you is medical advice.
- You must be 18 or older and the child's parent or legal guardian.
- Subscriptions are billed through Apple's App Store or Google Play. They auto-renew until you cancel. You cancel in your App Store or Google Play settings, not with us.
- You own the content you create (observations, notes, photos). You grant us a limited licence to store and process it so we can deliver the Service to you.
- AI-generated narratives are informational summaries of the data you logged. They are not a substitute for a paediatrician.
- If there is a dispute, Hong Kong law applies and, except where local law gives you a non-waivable right to a different forum, disputes are resolved by arbitration in Hong Kong (HKIAC).
1. Eligibility
You may use the Service only if:
- You are at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) and have full legal capacity to enter into a binding contract.
- You are the parent or legal guardian of the child whose information you record, and you have authority under applicable law to provide that information to us.
- You are not barred from receiving the Service under the laws of Hong Kong, your country of residence, or any other applicable jurisdiction (including any trade sanctions or export-control lists).
If you do not meet these conditions, you must not create an account or use the Service.
2. Your account
To use the Service, you create an account with an email address (and, optionally, Sign in with Apple or Sign in with Google). You are responsible for:
- keeping your credentials secret and secure;
- all activity that occurs under your account;
- ensuring the information you provide is accurate and kept up to date;
- promptly notifying us at privacy@learningtime.com.hk if you suspect unauthorised access.
You may close your account at any time from Settings → Account → Delete account. We may suspend or terminate your account as described in Section 11.
3. The Service — what it is, and what it is not
Learning Time offers:
- a structured way to record observations and milestones about your child's early development;
- suggestions for developmentally appropriate activities;
- a weekly recap view and progress indicators across developmental pillars;
- AI-generated narrative text summarising recent observations;
- optional reminders and notifications.
Important — what Learning Time is NOT:
- It is not a medical device, diagnostic tool, or telehealth service.
- It does not provide medical, psychological, educational, or legal advice.
- It does not replace consultation with a qualified paediatrician, child psychologist, or other licensed professional.
- Any developmental framework we present is a general reference based on widely used milestone guidance; it is not tailored to your child's specific medical situation.
If you are concerned about your child's health or development, please consult a qualified healthcare professional without delay.
We may modify, expand, or remove features from time to time. We will not materially reduce features of a paid subscription during its current billing period without offering you a refund or credit.
4. Subscriptions, billing, auto-renewal, and refunds
4.1 Plans
Certain features of the Service are available only through a paid subscription ("Subscription"). The available plans, their prices, and their features are displayed in the app before you confirm any purchase.
4.2 Free trial (if offered)
If we offer a free trial, you will see the trial length and the date on which billing begins before you confirm. If you do not cancel before the trial ends, your Subscription will begin and you will be charged the price shown.
4.3 Billing and auto-renewal
Subscriptions are sold and billed through Apple's App Store (on iOS) or Google Play (on Android), not directly by Learning Time. Purchases are subject to Apple's or Google's terms.
- Payment is charged to your Apple ID or Google account.
- Subscriptions auto-renew for successive periods of the same length at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Any unused portion of a free trial is forfeited when you start a paid Subscription.
4.4 Cancellation
You cancel your Subscription through your Apple ID settings or Google Play account — not in the Learning Time app. Instructions are linked from Settings → Subscription. After cancellation, you keep access until the end of the current billing period.
4.5 Refunds
Refunds are handled by Apple or Google according to their respective policies. We cannot issue refunds for App Store or Play Store purchases directly. In jurisdictions that give you a non-waivable statutory right to a refund (e.g., certain consumer-protection regimes in the EEA/UK), you may exercise that right as provided by law — contact us at privacy@learningtime.com.hk and we will cooperate in the process.
4.6 Price changes
If we change the price of a Subscription, we will give you at least 30 days' prior notice (by email and in-app). You may reject the new price by cancelling before the next renewal; continuing past the renewal date means you accept the new price.
4.7 Taxes
Prices are inclusive of value-added tax (VAT / GST / PPN) where required by law. Where tax must be added separately, Apple or Google will show it at checkout.
4.8 Restore Purchases
If you reinstall the app or switch devices, use Settings → Subscription → Restore Purchases to re-link your existing Subscription. This is required by Apple App Store Review Guideline 3.1.1.
5. Your content
"User Content" means everything you record in the Service: observations, milestone statuses, activity completions, mood check-ins, photos, notes, and your child's profile.
5.1 You own your User Content
As between you and us, you own your User Content. We do not claim any ownership of it.
5.2 Licence you grant to us
You grant Learning Time a worldwide, non-exclusive, royalty-free licence
to host, store, reproduce, transmit, and process your User Content solely
to operate and improve the Service for you. This licence includes the
right to send the minimum personalisation signals (first name or nickname,
age in months, gender, pillar category, recent observation summaries, and
milestone progress — but not date of birth, photos, last names, or contact
information) to our AI provider to generate narratives for you, and only
with your explicit ai_narratives consent.
This licence ends when you delete the content or close your account, subject to the retention periods described in our Privacy Policy.
We do not use your User Content to train any third-party AI model, sell it to advertisers or data brokers, or share it with anyone outside the processors listed in the Privacy Policy.
5.3 Your responsibility
You represent and warrant that:
- you have the right to provide the User Content (including any photos);
- your User Content does not violate the rights of any third party, including privacy, publicity, intellectual-property, or confidentiality rights;
- your User Content is not defamatory, obscene, or unlawful.
6. Acceptable use
When using the Service, you must not:
- use the Service for any unlawful purpose, or to violate any applicable law or regulation;
- attempt to reverse-engineer, decompile, or probe the Service, except to the extent such restriction is prohibited by applicable law;
- attempt to access another user's account, data, or any non-public area of our infrastructure;
- upload malicious code, viruses, or anything designed to disrupt the Service;
- scrape, harvest, or systematically download data from the Service;
- use the Service to harass, defame, or harm any person;
- upload sexually explicit imagery of any person, including — categorically — any imagery that exploits or endangers a child;
- submit content that is not about your own child, or content you do not have the authority to submit.
We reserve the right to remove content that violates these rules and to suspend or terminate accounts involved in serious or repeated violations.
7. Our intellectual property
The Service, including its design, code, logos, brand names, written content, illustrations, audio, and AI prompt templates, is owned by Learning Time or our licensors and is protected by copyright, trademark, and other intellectual-property laws in Hong Kong and internationally.
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, solely for your personal, non-commercial use of the Service and only while these Terms are in effect. All rights not expressly granted are reserved.
You must not remove or alter any copyright, trademark, or other proprietary notices displayed in the Service.
8. AI-generated content
The Service uses a third-party AI model (Alibaba Cloud International's Qwen, hosted in Singapore) to generate short narrative text based on the developmental signals you log. You acknowledge and agree that:
- AI-generated text is informational, not advisory;
- AI-generated text may contain errors, omissions, or mis-summaries;
- AI-generated text is not medical, diagnostic, psychological, or educational advice;
- AI-generated text does not create any professional, clinical, or fiduciary relationship between you and Learning Time;
- We make no warranty as to the accuracy, completeness, or fitness for any particular purpose of the AI-generated text.
If you spot AI output that is harmful, offensive, or factually wrong, please report it to us at privacy@learningtime.com.hk and we will investigate and, where warranted, refine our prompts and filters.
9. Disclaimers
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available", without warranty of any kind, express or implied.
- We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
- We do not warrant any particular developmental outcome or benefit.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- Learning Time will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, or personal injury arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.
- Our aggregate liability for any claim arising out of or in connection with these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.
Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot lawfully be excluded or limited in your jurisdiction.
11. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if:
- you materially breach these Terms or our Acceptable Use rules;
- we reasonably believe your account has been compromised;
- we are required to do so by law or by a valid order from a competent authority;
- we retire the Service — we will give you at least 30 days' notice and refund any pre-paid unused portion of a Subscription.
You may terminate these Terms at any time by deleting your account in Settings → Account → Delete account.
Sections 5.2 (licence), 7 (IP), 9 (disclaimers), 10 (liability), 13 (governing law), and any other provision that by its nature should survive, will survive termination.
12. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will:
- update the "Last updated" date at the top;
- post the new Terms in the app and on our website;
- where the change materially affects your rights or obligations, give you at least 30 days' prior notice (in-app banner and/or email) before the change takes effect; and
- where required by law, seek your fresh consent before applying the change to you.
If you do not agree with a change, you may stop using the Service and close your account. Continued use after the effective date of a change means you accept the updated Terms.
13. Governing law and dispute resolution
13.1 Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13.2 Arbitration
Except where prohibited by applicable consumer-protection law in your jurisdiction, any dispute, controversy, difference, or claim arising out of or relating to these Terms, including their existence, validity, interpretation, performance, breach, or termination, will be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

13.3 Consumer-law carve-out
If you are a consumer in a jurisdiction whose law grants you a non-waivable right to bring proceedings in a particular court or to benefit from particular consumer-protection rules, nothing in these Terms removes that right.
13.4 Small-claims exception
Either party may bring an individual action in small-claims court (or its equivalent) for disputes within that court's jurisdiction.
13.5 Injunctive relief
Either party may seek urgent injunctive or equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual-property rights or breach of confidentiality.
14. Apple App Store — additional terms
These additional terms apply if you downloaded Learning Time from Apple's App Store. They are required under Apple's Licensed Application End User License Agreement ("Apple LEULA").
- Parties. These Terms are a contract between you and Learning Time only, not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- Scope of licence. The licence granted in these Terms is limited to a non-transferable licence to use the app on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and support. Learning Time is solely responsible for providing any maintenance and support services with respect to the app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
- Warranty. We are solely responsible for any warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app.
- Product claims. Learning Time, not Apple, is responsible for addressing any claims relating to the app or your use of it, including: (i) product-liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation, including in connection with the app's use of the HealthKit and HomeKit frameworks (not used by this app).
- Intellectual-property claims. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual-property rights, Learning Time, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual-property infringement claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Any questions, complaints, or claims with respect to the app should be directed to: Learning Time Digital Limited, 5/F, 88 Lockhart Road, Wan Chai, Hong Kong. Email: privacy@learningtime.com.hk.
- Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
15. Google Play — additional terms
If you downloaded Learning Time from Google Play, your use is also subject to the Google Play Terms of Service. Refunds and purchases made through Google Play are handled by Google.
16. Country-specific additional terms
16.1 Indonesia 🇮🇩
For users in Indonesia, these Terms apply together with our Indonesian translation published at https://www.learningtime.com.hk/id/pages/terms-and-conditions. In the event of a conflict for Indonesian-resident users, the Indonesian version prevails.
By accepting these Terms you give your explicit consent (Article 20(a) of Law No. 27 of 2022 concerning Personal Data Protection, "UU PDP") to the processing of your personal data as described in our Privacy Policy, including cross-border transfer to Singapore (Supabase) and Singapore (Alibaba Cloud International / Qwen).
16.2 Hong Kong 🇭🇰
For users in Hong Kong, these Terms comply with the Personal Data (Privacy) Ordinance (Cap. 486). You may exercise data access and correction rights as described in Section 12.2 of our Privacy Policy.
16.3 Southeast Asia — Singapore, Malaysia, Thailand, Philippines
Local consumer-protection and personal-data laws apply in addition to these Terms. To the extent a mandatory local rule is more protective of you than a provision of these Terms, the local rule prevails.
16.4 European Economic Area and United Kingdom 🇪🇺 🇬🇧
Nothing in these Terms limits your statutory consumer rights under EU or UK law. The limitation of liability in Section 10 applies only to the extent permitted by your local law.
16.5 California, United States 🇺🇸
California residents may contact the California Department of Consumer Affairs' Complaint Assistance Unit in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at +1-800-952-5210. This notice is provided under California Civil Code § 1789.3.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. A failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or successor in connection with a merger, acquisition, or sale of assets, on notice to you.
- Notices. We may send notices to you by in-app banner, push, or to the email address on your account. You should send notices to us at privacy@learningtime.com.hk or at our registered address in Section 1.
- Force majeure. Neither party is liable for failure or delay caused by events beyond its reasonable control.
- Language. These Terms are drafted in English. Where a translation is provided (e.g., Bahasa Indonesia at https://www.learningtime.com.hk/id/pages/terms-and-conditions), the translation is for convenience; except for users in Indonesia (Section 16.1), the English version prevails in the event of conflict.
